A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §7-1-15, relating to
county commissions generally; authorizing county commissions
to adopt noise abatement ordinances; violation of such
ordinance to constitute a misdemeanor; and authorizing penalty
for violation.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §7-1-15, to read as
follows:
ARTICLE 1. COUNTY COMMISSIONS GENERALLY.
§7-1-15. Authority for establishing noise abatement ordinance;
penalty.
In addition to all other powers and duties now conferred by
law upon county commissions, such commissions are hereby authorized, by order duly entered of record, to adopt and enforce,
throughout the county or in any designated portion thereof, a noise
abatement ordinance which provides a misdemeanor penalty for
violation.
NOTE: The purpose of this bill is to authorize county
commissions to adopt and enforce noise abatement ordinances.
