A BILL to amend §64-3 of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, by adding thereto a new
section, designated §1, relating to authorizing the Department
of Environmental Protection to promulgate a legislative rule
relating to permits for the construction and major
modification of major stationary sources of air pollution
which cause or contribute to nonattainment.
Be it enacted by the Legislature of West Virginia:
That §64-3 of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, be amended by adding thereto a new
section, designated §1, to read as follows:
ARTICLE 3. AUTHORIZATION FOR BUREAU OF ENVIRONMENT TO PROMULGATE
LEGISLATIVE RULES.
§64-3-1. Department of Environmental Protection.
The legislative rule filed in the state register on the twenty-fifth day of August, two thousand four, under the authority
of section four, article five, chapter twenty-two, of this code,
relating to the Department of Environmental Protection (permits for
the construction and major modification of major stationary sources
of air pollution which cause or contribute to nonattainment, 45 CSR
19), is authorized.
NOTE: The purpose of this bill is to authorize the Department
of Environmental Protection to promulgate a legislative rule
relating to Permits for the Construction and Major Modification of
Major Stationary Sources of Air Pollution Which Cause or Contribute
to Nonattainment.
