A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §61-17-1, relating to abolishing mandatory prison sentences.

Be it enacted by the Legislature of West Virginia:

ARTICLE 17. ABOLISHMENT OF mandatory prison sentencing.


§61-17-1. Abolishment of mandatory prison sentences.


Notwithstanding any provision in this code to the contrary, mandatory or prescribed prison sentencing and sentences are hereby abolished. Any mandatory or prescribed sentences referred to in this code shall be hereinafter be read as being the maximum sentence allowed by law and the courts.

 

NOTE: The purpose of this bill is to abolish mandatory prison sentences.
