A BILL to amend and reenact section seventeen, article two-c, chapter thirteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to requiring notice to, and consent of, school boards before selling bonds or signing mortgages, trust deeds and contracts, under certain conditions.

Be it enacted by the Legislature of West Virginia:

That section seventeen, article two-c, chapter thirteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:

ARTICLE 2C. INDUSTRIAL DEVELOPMENT AND COMMERCIAL DEVELOPMENT BOND ACT.

§13-2C-17. No notice, consent or publication required; school board exception.

No notice to or consent or approval by any other governmental body or public officer shall be is required as a prerequisite to the issuance or sale of any bonds or the making of any agreement, a mortgage or deed of trust under the authority of this article. No publication or notice shall be is necessary to the validity of any resolution or proceeding had under this article, except for notice to and the consent and approval of school boards of the counties which have jurisdiction over the same or a portion of the county or municipality that is proposing to issue the bonds or enter into any agreement, mortgage or deed of trust pursuant to this article. No publication or notice shall Notice to and approval of the school board is necessary to the validity of any resolution or proceeding under this article.


NOTE: The purpose of this bill is to except school boards from those governmental bodies or public officers to whom no notice, consent or publication is necessary regarding an intention to issue bonds or enter into an agreement, mortgage or deed of trust.
