A BILL to amend and reenact §30-10-9 of the code of West Virginia,
1931, as amended, relating to the licensing of veterinarians;
the issuance of temporary permits to certain otherwise
qualified applicants; and allowing for the issuance of a
temporary permit to otherwise qualified graduates of foreign
veterinary schools who are waiting to take clinical
proficiency examination, as long as their activities are under
the direct supervision and control of a licensed veterinarian.
Be it enacted by the Legislature of West Virginia:
That §30-10-9 of the code of West Virginia, 1931, as amended,
be amended and reenacted to read as follows:
§30-10-9. Temporary permits.
(a) The board may issue without examination a temporary permit
to practice veterinary medicine in this state:
(a) (1) To a qualified applicant for license pending
examination: Provided, That such temporary permit shall expire the
day after the giving of notice of the results of the first
examination held after the permit is issued;
(2) To an otherwise qualified applicant for license pending examination who has met all of the qualifications for certification
from the Education for Foreign Veterinary Graduates, with the
exception of the Clinical Proficiency Examination: Provided, That
the veterinary practice conducted pursuant to the temporary permit
are conducted under the direct and personal instruction, control or
supervision of a licensed veterinarian; Provided, however, That the
duration of any such temporary permit granted by the board shall not
extend beyond the time necessary for the permit holder to take and
receive the results of the Clinical Proficiency Examination.
(b) (3) To a nonresident veterinarian validly licensed in
another state, territory, or district of the United States or a
foreign country who pays the registration fee specified in the fee
schedule established and published by the board. A temporary
permit shall not be issued to a nonresident veterinarian for a
period of more than sixty days, but may be renewed in the
discretion of the board.
(b) For purposes of this section, "direct and personal
instruction, control or supervision" means that a veterinarian
licensed by the board is physically in the immediate proximity and
personally supervising a temporary permittee while a permittee is
practicing acts of veterinary medicine: Provided, That in instances
where a permittee is at a temporary site for the purpose of
delivering services to large animals or if a permittee is
administering emergency services not during regular office hours,
phone contact constitutes direct and personal instruction, control
or supervision.
(c) A temporary permit may be summarily revoked by majority
vote of the board without a hearing.
NOTE: The purpose of this bill is to allow the West Virginia
Board of Veterinary Medicine to issue temporary permits to practice
veterinary medicine to otherwise qualified graduates of foreign
veterinary schools who are waiting to take clinical proficiency
examination, as long as their activities are under the direct
supervision and control of a licensed veterinarian.
