A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §55-2-1b, relating to
requiring certification that the offer of proof of the value
of property sought to be introduced in an action or suit be at
least ninety percent accurate.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §55-2-1b, to read as
follows:
ARTICLE 2. LIMITATION OF ACTIONS AND SUITS.
§55-2-1b. Offered proof of value to be at least ninety percent
accurate.
Whenever the value of any property either real or personal is
at issue in an action or suit, each of the parties thereto shall,
by affidavit sworn to by the attorney or attorneys representing a
party submitting an offer of proof of the value of the property,
certify that the offer of proof of value placed on the property by the party is at least ninety percent accurate.
NOTE: The purpose of this bill is to
require certification
that the offer of proof of the value of property sought to be
introduced in an action or suit be at least ninety percent
accurate.
