A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5A-8-21, relating to
nondisclosure of personal information of state employees and
officers, and their dependants.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5A-8-21, to read as
follows:
ARTICLE 8. PUBLIC RECORDS MANAGEMENT AND PRESERVATION ACT.
§5A-8-21. Records of state employees and officers, and dependants.
The following information maintained by state agencies or
entities with respect to state employees and officers, and their
dependants, and retirees of any system administered by the
consolidated public retirement board, is personal information, and
is hereby exempted from disclosure under the provisions of article one, chapter twenty nine-b of this code, and may not be released by
state agencies or entities to nonstate entities, unless necessary
to an essential function of a state agency or entity, or
law-enforcement agency, or required by law: Home address, social
security number, home telephone number, payroll deductions, credit
card numbers, debit card numbers, driver's license identification
number, marital status and maiden name.
NOTE: The purpose of this bill is to prevent the disclosure
of personal information of state employees and officers, and their
dependants.
