A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §21-11-21; and to amend said code by adding thereto a new section, designated §29-3-33, all relating to requiring contractors to provide all required information on a construction project to the State Fire Commission or the State Fire Marshall; relieving the person who has hired the contractor from submitting the same information twice; and requiring the State Fire Commission and the State Fire Marshall to create forms and provide them to the West Virginia Contractor Licensing Board for contractors to use.

Be it enacted by the Legislature of West Virginia:

ARTICLE 11. WEST VIRGINIA CONTRACTOR LICENSING ACT.


§21-11-21. Contractor to provide information.

A contractor shall submit any information required by the State Fire Commission or the State Fire Marshall pertaining to a construction project, or the individual who has hired the contractor to perform the work, on forms provided by the State Fire Commission or the State Fire Marshall pursuant to §29-3-33 of this code. The individual who has hired the contractor to perform the work need only to provide any required information to the contractor and not the State Fire Commission or the State Fire Marshall.

ARTICLE 3. FIRE PREVENTION AND CONTROL ACT.


§29-3-33. Contractor forms.

The State Fire Commission and the State Fire Marshall shall create and provide forms to the West Virginia Contractor Licensing Board for all necessary information relating to a construction project. The contractor, not the individual who has hired the contractor, is responsible for providing the required information on the construction project.


 

NOTE: The purpose of this bill is to require contractors to provide all required information on a construction project to the State Fire Commission or the State Fire Marshall. The bill relieves the person who has hired the contractor from submitting the same information twice. The bill requires the State Fire Commission and the State Fire Marshall to create forms and to provide them to the West Virginia Contractor Licensing Board for contractors to use.
