A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated section §15-2-24a,
relating to ratifying the National Crime Prevention and
Privacy Compact.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §15-2-24a, to read as
follows:
ARTICLE 2. WEST VIRGINIA STATE POLICE.
§15-2-24a. National Crime Prevention and Privacy Compact.
The Legislature of West Virginia approves and ratifies the
National Crime Prevention and Privacy Compact, 42 U.S.C. §14616, as
it existed on the first day of January, two thousand six, and the
compact shall remain in effect in this state until the Legislature
renounces the compact by statute. The Superintendent of the West Virginia State Police shall execute, administer, and implement the
compact on behalf of the state, and may adopt necessary rules,
regulations, and procedures for the national exchange of criminal
history records for noncriminal records purposes. Ratification of
the compact does not affect the obligations and responsibilities of
the State Police criminal records section regarding the
dissemination of criminal history records within West Virginia.
NOTE: The purpose of this bill is to join twenty-one other
states in ratifying the National Crime Prevention and Privacy
Compact to streamline the transfer of criminal history records for
noncriminal purposes between states that ratify the compact.
