A BILL to amend and reenact §62-6-2 of the Code of West Virginia,
1931, as amended, relating to providing criminal penalties for
violating a peace bond.
Be it enacted by the Legislature of West Virginia:
That §62-6-2 of the Code of West Virginia, 1931, as amended,
be amended and reenacted to read as follows:
ARTICLE 6. MISCELLANEOUS PROVISIONS CONCERNING CRIMINAL
PROCEDURES.
§62-6-2. Failure to give recognizance to keep the peace; fine;
commitment to jail.
A person not giving and for whom no other person gives, a
recognizance to keep the peace
shall be committed to jail. He
shall be discharged therefrom when such recognizance is given
before the court or justice, or when the period for which it was
required has elapsed, or when the discharge of such person is
directed by the court or justice having jurisdiction thereof may be
fined not more than two hundred fifty dollars or incarcerated in
jail for not more than twenty-four hours or both fined and incarcerated.
NOTE: The purpose of this bill is to provide criminal
penalties for violating a peace bond.
