A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §16-2J-1, relating to
requiring daily supervision of facilities that perform three
or more abortion procedures in a calendar year; providing for
the closure of noncomplying facilities; and providing a civil
fine for violations.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §16-2J-1, to read as
follows:
ARTICLE 2J. ABORTIONS.
§16-2J-1. Supervision of facilities performing three or more
abortion procedures; closure; penalty.
Every facility that performs three or more abortion procedures each calendar year shall be under the daily supervision of a person
who is duly licensed and qualified to operate a medical facility in
this state.
Any facility found to be in violation of the provisions of
this article shall be closed for not less than three years and
assessed a fine of not less than five thousand dollars.
Nothing in this article may be construed or interpreted to
condone, permit, or endorse any abortion.
NOTE: The purpose of this bill is to
require facilities that
perform three or more abortion procedures during a calendar year be
under daily supervision by a licensed and qualified medical
facility operator.
