A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17C-15-51, relating to requiring motor vehicles, trailers or semitrailers having a hydraulically operated bed to have a warning device that will alert the operator when the vehicle is in motion and the bed is in an upward position; and requiring rulemaking.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §17C-15-51, to read as follows:

ARTICLE 15.  EQUIPMENT.

§17C-15-51.  Hydraulic lift warning device.

(a) On or before January 1, 2018 every motor vehicle, truck, trailer or semitrailer having a hydraulically operated bed shall include a warning device that will alert the driver in the event the bed is in an upward position when the vehicle is in motion.

(b) The Commissioner of the Division of Motor Vehicles shall propose rules for legislative approval in accordance with article three, chapter twenty-nine-a of the code to implement this section.

NOTE: The purpose of this bill is to require motor vehicles, trailers or semitrailers having a hydraulically operated bed have a warning device that will alert the operator when the vehicle is in motion and the bed is in an upward position. The bill requires rule-making.
