A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §22A-2-71b, relating to providing whistle-blower protection to miners who complain to government authorities about health or safety hazards existing at the nonunion mine sites where they are employed.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §22A-2-71b, to read as follows:
ARTICLE 2. UNDERGROUND MINES.
§22A-2-71b. Whistle-Blower Protection for complainants in nonunion mines.

In the event any miner or other employee employed at a nonunion mine site complains to any public agency, including the Office of Miner's Health, Safety and Training, concerning the existence of any perceived health or safety hazard at the mine site,
the public agency and its employees, including the Office of Miner's Health, Safety and Training and its employees, may not divulge the identity of the complainant unless the complainant agrees in writing that his or her identity may be divulged.



NOTE: The purpose of this bill is to
provide whistle-blower protection to miners who complain to government authorities about health or safety hazards existing at the nonunion mine sites where they are employed.
