A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §9-5-20, relating to requiring the Bureau for Medical Services to conduct a criminal background investigation on Medicaid provider applicants and on existing Medicaid providers who have not previously undergone a criminal background investigation .

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §9-5-20, to read as follows:
ARTICLE 5. MISCELLANEOUS PROVISIONS.
§9-5-20. Criminal background investigations of Medicaid provider applicants.

The Bureau for Medical Services shall conduct a criminal background investigation on Medicaid provider applicants and on existing Medicaid providers in the West Virginia Medicaid Program who have not previously undergone a criminal background investigation to determine if the applicant or provider has been charged, indicted or convicted of a crime that may have bearing on the fitness of an applicant or provider to provide Medicaid services. The background investigation must minimally include the following:
(1) Fingerprinting of applicants and providers for submission to the Federal Bureau of Investigation for a national criminal history background check; and
(2) Review of any other readily accessible state or federal criminal history records that may be pertinent to the background investigation.
The Bureau of Medical Services shall propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a of this code to implement the provisions of this section.



NOTE: The purpose of this bill is to require the Bureau of Medical Services to conduct a criminal background investigation on Medicaid provider applicants and on existing Medicaid providers who have not previously undergone a criminal background investigation.
