A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §24-2-19, relating to
requiring the Public Service Commission to conduct quarterly
safety inspections of propane tanks.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §24-2-19, to read as
follows:
ARTICLE 2. POWERS AND DUTIES OF PUBLIC SERVICE COMMISSION.
§24-2-19. Propane tank inspection.
Beginning the first day of January two thousand nine, in
addition to all other duties herein prescribed, the commission
shall be responsible to conduct quarterly inspections of all
propane tanks, used for residential or commercial purposes, in this
state. The commissioner is hereby directed to propose rules for legislative approval in accordance with the provisions of article
three, chapter twenty-nine-a of this code designed to provide and
train an adequate number of inspectors to perform quarterly
inspections of all such tanks. The rules shall include minimum
conditional standards related to the safe use, storage and
operation of propane tanks including conditional standards related
to tubing, regulators or other apparatus used in the operation of
propane tanks.
NOTE: The purpose of this bill is to require the Public
Service Commission to conduct quarterly safety inspections of
propane tanks.
