A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §60-6-26, relating to granting the authority to counties and municipalities to curtail the serving of alcoholic beverages by licensed clubs as early as one A.M.; and providing an exception for those clubs that also hold video lottery licenses.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding a new section, designated §60-6-26, to read as follows:

ARTICLE 6. MISCELLANEOUS PROVISIONS.

§60-6-26. Powers of counties and municipalities; exception.

    Notwithstanding any provision in this code to the contrary, a county or any municipality has the authority to require a club, licensed pursuant to article seven of this chapter, to stop the sale of alcoholic liquors as early as one a.m. However, clubs that also hold limited video lottery licenses may continue to remain open to their patrons but must stop the sale of alcoholic liquors at one a.m. This section does not apply to racetracks that are licensed to conduct video lottery games.




    NOTE: The purpose of this bill is to grant the authority to counties and municipalities to curtail the serving of alcoholic beverages by licensed clubs as early as one a.m. The bill also provides that those clubs that also hold video lottery licenses may continue to remain open for lottery patrons but must cease serving alcoholic liquors at 1 a.m.


    This section is new; therefore, it has been completely underscored.
