A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §48-1-308, relating
to requiring both parents to be equally responsible for a
child's funeral expenses.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §48-1-308, to read as
follows:
ARTICLE 1. GENERAL PROVISIONS; DEFINITIONS.
§48-1-308. Child's funeral expenses.
Unless otherwise specified in a binding divorce decree or
legal separation agreement, both legal parents are financially
responsible for their child's funeral and graveyard expenses.
NOTE: The purpose of this bill is to require both legal
parents to be equally responsible for a child's funeral expenses.
