A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5-5-2a, relating to
retention salary increases for Division of Corrections' and
Division of Juvenile Services' employees based on years of
service.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5-5-2a, to read as
follows:
ARTICLE 5. SALARY INCREASE FOR STATE EMPLOYEES.
§5-5-2a. Retention incentive salary increases for employees of the
Division of Corrections.
(a) Effective the first day of July, two thousand five, every
employee of the Division of Corrections and the Division of
Juvenile Services with two years of employment with the Division of
Corrections shall receive a salary increase of one thousand dollars
on the two-year anniversary of their employment with the Division. (b) Every employee of the Division of Corrections and the
Division of Juvenile Services shall receive an additional salary
increase of one thousand dollars on the anniversary of their fifth
year of continuous service with the Division of Corrections or the
Division of Juvenile Services and every three years thereafter on
the anniversary of their continuous employment with the Division of
Corrections or the Division of Juvenile Services.
(c) This section shall not be construed to prohibit other pay
increases based on merit, seniority, promotion or other reason, if
funds are available for the other pay increases: Provided, That
the executive head of each spending unit shall first grant the
mandated increase in compensation in this section to all eligible
employees prior to the consideration of any increases based on
merit, seniority, promotion or other reason.
NOTE: The purpose of this bill is to provide retention salary
increases for Division of Corrections and the Division of Juvenile
Services employees only.
