A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated
§20-2-5c,
relating to
prohibiting fishing in rivers and streams stocked with trout
on days when trout are released; and requiring the Division of
Natural Resources to publish the dates of stocking so that
people will know when they may not fish.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated
§20-2-5c
, to read as
follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-5c. Fishing in rivers stocked with trout on days when trout
are released; penalties.
Fishing is prohibited in rivers and streams stocked with trout
on days when trout are released into such river or stream between one-half hour before the official sunrise and one-half hour after
the official sunset. Any person who violates this section is
guilty of a misdemeanor and, upon conviction thereof, shall be
fined not less than fifty dollars nor more than three hundred
dollars, or imprisoned in jail not less than ten nor more than one
hundred days, or both fined and imprisoned. The Division of
Natural Resources shall propose rules for legislative approval in
accordance with the provisions of article three, chapter
twenty-nine-a of this code which designate specific days for
stocking.
NOTE: The purpose of this bill is to prohibit fishing in
stocked streams and rivers on days when trout are released into
such streams and rivers.
