A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17A-2-24, relating to requiring the Commissioner of the Division of Motor Vehicles to create a special registration plate for full-size special purpose off-road vehicles, self-assembled or modified original equipment manufactured vehicles, that would give the vehicles the same limited access to roads as all-terrain vehicles; establishing a fee; and requiring rulemaking.

Be it enacted by the Legislature of West Virginia:


ARTICLE 2. DIVISION OF MOTOR VEHICLES.


§17A-2-24.  Special registration plates for full-size special- purpose, off-road vehicles, self-assembled or modified original equipment manufactured vehicles; fee; rule-making.

(a) The commissioner shall make available a special registration plate that would allow full-size special-purpose, off-road vehicles, self-assembled or modified original equipment manufactured vehicles that would otherwise not qualify to be registered as a Class A vehicle under §17A-3-1 et seq. of this code, that allows the same limited access to roads as all-terrain vehicles have under §17F-1-1 et seq. of this code.

(b) The commissioner shall charge an annual fee of $30 for the plate, or may issue a lifetime plate for the vehicle at a fee to be determined by the commissioner in a legislative rule.

(c) The plate is required to drive the vehicle on public lands that are opened for use by all-terrain vehicles after the effective date of this section.

(d) The commissioner shall propose rules for legislative approval necessary to implement this section. The rules shall include, but are not limited to, safety, emission and noise reduction equipment a vehicle must have to qualify for a plate issued under this section.

 

NOTE: The purpose of this bill is to require the Commissioner of the Division of Motor Vehicles to create a special registration plate for full-size special purpose off-road vehicles, self-assembled or modified original equipment manufactured vehicles, that would give the vehicles the same limited access to roads as all-terrain vehicles. The bill establishes fees; requires rulemaking.
