A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §29-25-23a, relating
to prohibiting account wagering and electronic betting.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §29-25-23a, to read as
follows:
ARTICLE 25. AUTHORIZED GAMING FACILITY.
§29-25-23a. Prohibition on account wagering and electronic
betting.
(a) For the purposes of this section:
(1) "Account wagering" means the act of making a wager from a
financial account exclusively opened and designed for the purpose
of providing funds, or a line of credit, to be used to gamble on
any type of game of chance.
(2) "Electronic betting" means the act of placing a bet on any
game of chance, through any electronic means, including, but not
limited to, internet, telephone or cable transmission.
(b) A gaming licensee, including any race track or other
gaming center or establishment, may not provide or maintain any
service or device which, in effect, constitutes a financial account
or line of credit to be used for the purpose of account wagering.
Nor may a gaming licensee, including any race track or other gaming
center or establishment, provide, maintain or possess any service
or equipment intended for use, in whole or in part, for electronic
betting.
NOTE: The purpose of this bill is to prohibit account
wagering and electronic betting.
