A BILL to amend and reenact section six, article nine, chapter seventeen-c of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to moving traffic regulations generally and increasing the penalty for failure of a driver to yield the right-of-way.

Be it enacted by the Legislature of West Virginia:
That section six, article nine, chapter seventeen-c of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:
ARTICLE 9. RIGHT-OF-WAY.

§17C-9-6. Misdemeanor to violate provisions of article; penalty.

Any person violating the provisions of this article is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than one hundred dollars; upon a second conviction within one year thereafter, shall be fined not more than two hundred dollars; and upon a third or subsequent conviction, shall be fined not more than five hundred dollars shall be fined not more than five hundred dollars; upon a second conviction within one year thereafter, shall be fined not more than one thousand dollars; and upon a third or subsequent conviction, shall be fined not more than one thousand dollars or confined in the county or regional jail for not more than ten days, or both fined and imprisoned.




NOTE: The purpose of this bill is to increase the misdemeanor penalties for failure to yield the right-of-way.
