A BILL to amend and reenact §17C-3-7 of the Code of West Virginia,
1931, as amended, relating to illuminated flashing yellow
signals; providing that on four lane highways when flashing
yellow signals are used to indicate that there is a traffic
signal ahead, the yellow light may only flash when the traffic
signal is about to turn from yellow to red; and requiring, in
that instance, a sign to be erected informing motorists that
when it is flashing they should be prepared to stop.
Be it enacted by the Legislature of West Virginia:
That §17C-3-7 of the Code of West Virginia, 1931, as amended,
be amended and reenacted to read as follows:
ARTICLE 3. TRAFFIC SIGNS, SIGNALS AND MARKINGS.
§17C-3-7. Flashing signals.
Whenever an illuminated flashing red or yellow signal is used in a traffic sign or signal it shall require obedience by vehicular
traffic as follows:
(1) Flashing red (stop signal). -- When a red lens is
illuminated with rapid intermittent flashes, drivers of vehicles
shall stop before entering the nearest crosswalk at an intersection
or at a limit line when marked, or, if none, then before entering
the intersection, and the right to proceed shall be subject to the
rules applicable after making a stop at a stop sign.
(2) Flashing yellow (caution signal). -- When a yellow lens is
illuminated with rapid intermittent flashes, drivers of vehicles
may proceed through the intersection or past such signal only with
caution. However, where that flashing yellow caution signals are
used to provide notice to drivers on four-lane divided highways
that they are approaching a traffic signal, these lights may flash
only when that traffic signal is actually preparing to go to a red
or yellow signal. In that instance, a flashing yellow caution
signal shall be marked with a sign notifying drivers that when the
signal is flashing motorists should be prepared to stop.
__________NOTE: The purpose of this bill is to provide that on four lane
highways when flashing yellow signals are used to indicate that
there is traffic signal ahead the yellow light may only flash when
the traffic signal is about to turn from yellow to red. The bill
provides in that instance a sign shall be erected informing
motorists that when it is flashing they should be prepared to stop.
