A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §30-3-13a, relating
to prohibiting a radiologist from performing a second reading
of an X ray without written authorization from the patient
when the X ray has already been read and treatment rendered by
the primary physician.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §30-3-13a, to read as
follows:
ARTICLE 3. WEST VIRGINIA MEDICAL PRACTICE ACT.
§30-3-13a. Radiologists performing second reading of X ray;
authorization required.
When a primary physician has caused an X ray to be taken on a patient and has read that X ray in the course of making a diagnosis
and rendering treatment to the patient, the physician may not
subsequently send that X ray to a radiologist for a second reading
after treatment on the patient has already been rendered unless the
physician obtains a written authorization from the patient to do
so.
NOTE: The purpose of this bill is to prohibit a radiologist
from performing a second reading of an X ray without written
authorization from the patient when the X ray has already been read
and treatment rendered by the primary physician.
