A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §30-27-5a, relating
to the creation of an apprenticeship program for barbers and
cosmetologists; directing the board of Barbers and
Cosmetologists to propose rules for such program.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §30-27-5a, to read as
follows:
ARTICLE 27. BOARD OF BARBERS AND COSMETOLOGISTS.
§30-27-5a. Barber and cosmetologists apprenticeship program.
(a) An approved barber and cosmetologist apprenticeship shall:
(1) Consist of not less than one thousand two hundred fifty
hours of training in not less than ten months; and
(2) Be conducted by a supervisor who:
(A) Is licensed under this article as a barber or
cosmetologist; and
(B) Provides direct one-on-one supervision of the apprentice
during the apprenticeship program.
(b) A barber or cosmetologist may only have one apprentice at
a time.
(c) A sign bearing the words "Apprentice in Training" shall be
conspicuously placed near the apprentice's workstation.
(d) The barber or cosmetologist instructing the apprentice and
the apprentice shall document training in daily records to include:
(1) Hours of practical instruction;
(2) The number and type of client services performed; and
(3) Other services which document training hours.
(e) A barber or cosmetologist shall make available a complete
set of barber or cosmetologist texts to apprentice.
(f) An apprentice may be compensated for services performed.
(g) A barber or cosmetologist shall provide apprentice with
training and technical instruction of one thousand two hundred
fifty hours using the curriculum defined by the Board of Barbers
and Cosmetologists.
(h) The barber or cosmetologist shall limit an apprentice's
training to forty hours per week, five days a week.
(i) An apprentice may not perform work on the public until
receiving at least ten percent of the required technical training hours.
(j) Any cosmetology/barber school hours earned by apprentice
do not satisfy required apprenticeship training hours.
(k) The State Board of Barbers and Cosmetologists shall
propose rules for legislative approval in accordance with the
provisions of article three, chapter twenty-nine-a of this code to
establish a barber apprenticeship training program and curriculum
using this section as a guide.
NOTE: The purpose of this bill is to establish a barber and
cosmetologist apprenticeship program.
