A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §17A-3-2a, relating
to requiring owners of all-terrain vehicles to receive
registration tags from the Division of Motor Vehicles
displaying; and providing penalties for noncompliance.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §17A-3-2a, to read as
follows:
ARTICLE 3. ORIGINAL AND RENEWAL OF REGISTRATION; ISSUANCE OF
CERTIFICATES OF TITLE.
§17A-3-2a. All-terrain vehicle registration tag; penalties.
Notwithstanding any provision of this code to the contrary,
every owner of an all-terrain vehicle shall make application to the division for a registration tag for the all-terrain vehicle upon
the appropriate form or forms furnished by the division and every
registration tag shall display the vehicle identification number
and the address of the owner.
Every owner of an all-terrain vehicle that fails to comply
with the registration tag requirements of this section is guilty of
a misdemeanor and, upon conviction thereof, shall be fined not more
than five hundred dollars. Any owner of an all-terrain vehicle
violating this section for a second offense shall have the all-
terrain vehicle confiscated, and is guilty of a misdemeanor and,
upon conviction thereof, shall be fined not more than one thousand
dollars or confined for ten days in jail, or both.
NOTE: The purpose of this bill is to
require owners of
all-terrain vehicles to receive registration tags from the Division
of Motor Vehicles displaying; and to provide penalties for
noncompliance.
