A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5D-1-5c, relating to
transferring remaining bonding functions of public energy
authority to state treasurer.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5D-1-5c, to read as
follows:
ARTICLE 1. PUBLIC ENERGY AUTHORITY OF THE STATE OF WEST VIRGINIA.
§5D-1-5c. Powers and duties related to bonding transferred to
state treasurer.
Notwithstanding any other provision of this article, all
powers and duties of the public energy authority related to bonding
authority, including statutory responsibilities and contractual
obligations related to outstanding bonded indebtedness existing at the effective date of this section, are transferred to the state
treasurer.
NOTE: The purpose of this bill is to transfer from the Public
Energy Authority to the State Treasurer, responsibility to service
bonds previously issued by the Authority.
