A BILL to amend and reenact section two, article one-a, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to uniform application forms for credentialing, recredentialing and updating information for health care practitioners.

Be it enacted by the Legislature of West Virginia:
That section two, article one-a, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended to read as follows:
ARTICLE 1A. HEALTH CARE PLANNING COMMISSION.
§16-1A-2. Development of uniform credentialing application forms.

Notwithstanding any provision of this code to the contrary, the secretary of the department of health and human resources and the insurance commissioner, on or before the first day of June, two thousand two, shall jointly propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a of this code which set forth governing the development and use of uniform application forms for credentialing, recredentialing or updating information and to specify the of health care practitioners who shall utilize required to use the forms.

(NOTE: The purpose of this bill is to correct a conflict between this section and section three which permits the uniform application forms to be amended by procedural rule.

This bill is recommended by the legislative rule-making review committee for passage during the 2003 regular session.)
