The House of Delegates met at 11:00 a.m., and was called to order by the Honorable Richard
Thompson, Speaker.
Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
The Clerk proceeded to read the Journal of Monday, February 16, 2009, being the first order
of business, when the further reading thereof was dispensed with and the same approved.

In accordance with the former direction of the Speaker, the bills (H. B. 2214, H. B. 2215 and

Resolutions Introduced
Delegates White and Kominar offered the following resolution, which was read by its title
and referred to the Committee on Rules:
H. C. R. 4 - "Requesting the West Virginia Division of Highways to name West Virginia
Bridge Number 4069, located on Corridor G, at the mouth of Chattaroy in Mingo County, West
Virginia."
Whereas, Chief Boson's Mate, Howard W. Banister was born July 6, 1929 in the town of
Holden in Logan County, West Virginia, the son of Herbert and Beula Pack Bannister; and
Whereas, Chief Howard W. Bannister made a career with the U.S. Navy, having served on
active duty for more than eighteen years, and rose to the rank of Chief Boson's Mate; and
Whereas, Chief Howard W. Bannister was serving on a River Assault Craft as a member
of an elite Navy Seal team in Long An, South Vietnam; and
Whereas, Chief Howard W. Bannister and team were on a covert operation when the craft
took a hit from an enemy recoiless rifle round on July 11, 1967, which ended his life; and
Whereas, Chief Howard W. Bannister received the Purple Heart and other distinguished
decorations; and
Whereas, Chief Howard W. Bannister left a wife, Alice Bannister and children; and
Whereas, The ultimate sacrifice of this brave and courageous son of Mingo County, West
Virginia requires us to honor Chief Boson's Mate Howard W. Bannister, by ensuring that future
generations are aware of his sacrifice to the cause of freedom; therefore, be it
Resolved by the Legislature of West Virginia:
That the Legislature hereby requests the West Virginia Division of Highways to name Bridge
Number 4069, located on Corridor G at the mouth of Chattaroy in Mingo County, West Virginia
the "CBM Howard W. Bannister Memorial Bridge"; and, be it
Further Resolved, That the Commissioner of the Division of Highways is hereby requested
to cause to be fabricated signs to read in prominent lettering: "CBM Howard W. Bannister Memorial
Bridge" which signs shall be erected at each entrance of the bridge, indicating that the bridge has
been so named; and, be it
Further Resolved, That the Clerk of the House mail a certified copy of this resolution to the
Secretary of Transportation, the Commissioner of the Division of Highways and the family of Chief
Boson's Mate Howard W. Bannister.
Delegates Mahan, Fleischauer, Brown, Eldridge, Ennis, Ashley, Rowan and Schadler offered
the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 5 - "Requesting the Joint Committee on Government and Finance study, safety
issues surrounding the delivery of services that occur during home visits conducted by employees
and contractors of the Department of Health and Human Resources in the state of West Virginia."
Whereas, delivery of in-home services by employees and contractors of the Department of
Health and Human Resources is vital in many instances to the preservation of family units to
develop a safe and secure home environment for children and their families; and
Whereas, the persons who provide home visits are dedicated and caring individuals that
strive to ensure that families in need receive high quality care to empower these families to become
well balanced and cohesive; and
Whereas, in many instances in the performance of the duties necessary for a home visit, these individuals put their own personal safety at risk; and
Whereas, on July 30, 2008, Brenda Yeager a contract employee of the Department of
Health and Human Resources, made such a home visit and was brutally attacked and murdered
raising the awareness of the need to provide more effective personal safety of individuals involved
in this type of work; and
Whereas, safety concerns for employees and contractors of the Department of Health and
Human Resources should be studied to gain a full understanding of the scope of these home visits,
and to identify safety issues and develop possible solutions; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to study the issue
of the safety of individuals, both those who are employees of the State and those under contract to
the State, who provide home visits to families in West Virginia; and, be it
Further Resolved, That the Joint Committee on Government and Finance, seek input from
the Department of Health and Human Resources and from private agency providers on safety
concerns and considerations; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the
Legislature, on the first day of the regular session, two thousand ten, on its findings, conclusions and
recommendations together with drafts of any legislation to effectuate its recommendations; and, be
it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and
to draft necessary legislation be paid from legislative appropriations to the Joint Committee on
Government and Finance.
Delegates Mahan, Fleischauer, Brown, Eldridge, Ennis, Ashley, Rowan and Schadler offered
the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 6 - "Requesting the Joint Committee on Government and Finance reconstitute
Select Committee A on Children, Juveniles and Other Matters during the Interim period of the Seventy-Ninth Legislature."
Whereas, Select Committee A was appointed following the conclusion of the two thousand
five Regular Session of the Seventy-seventh Legislature of West Virginia in response to a growing
need for immediate oversight of child welfare matters; and
Whereas, In its two year history Select Committee A has begun the process of a
comprehensive review of the child welfare service delivery within the Bureau for Children and
Families; and
Whereas, During the course of its work Select Committee A has been assigned to study the
topics related to recruitment and retention of Child Protective Service workers, a study of child
advocacy center criteria, and other important issues related to the protection of children and
juveniles; and
Whereas, The efforts of Select Committee A have improved the delivery of services of
child welfare services; and
Whereas, Select Committee A had a strong interest in continuing to address, among other
matters, strengthening investigation options in child abuse and neglect matters, increasing penalties
for individuals convicted of child abuse and neglect and addressing the problem of drug and alcohol
abuse by parents relative to child abuse and neglect; and
Whereas, The provisions of legislation passed during a Special Session of the Legislature
called by Governor Joe Manchin in two thousand six where proposals originally suggested for
passage by the Legislature by Select Committee A, these include the implementation of a Child
Abuse Registry and the Development of a Special Victim's Unit within the State Police; and
Whereas, The work of Select Committee A should be continued to provide continued
protection to children and families during the the next Interim period; therefore, be it
Resolved by the Legislature of West Virginia:
That Select Committee A be reconstituted during the Interim period of the Seventy-Eighth
Legislature to continue its vital work on issues pertinent to child abuse and neglect; and, be it
Further Resolved, That Select Committee A report to the regular session of the Legislature,
2010, on its findings, conclusions and recommendations, including drafts of any recommendations,
together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That at times throughout the next interim period, Select Committee A may
seek collaboration with the Legislative Oversight Committee on Regional Jails and Correctional
Facility Authority and requesting a joint meeting to address issues the two committees may have in
common; and, be it
Further Resolved, That the Committee may request periodic reports from appropriate state
agencies, including but not limited to, the Division of Juvenile Services and the Bureau for Children
and Families within the Department of Health and Human Resources; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and

Delegate Carmichael addressed the House concerning the economic situation in the State and
the recent closing of Century Aluminum's plant in Ravenswood.
At the conclusion of his remarks, Delegate Armstead asked and obtained unanimous consent
that they be printed in the Appendix to the Journal.
