A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §9-8-1 and §9-8-2,
all relating to making elder-care and in-home health care
available to all seniors aged sixty-five or older, on a
sliding scale based on ability to pay.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §9-8-1 and §9-8-2, all
to read as follows:
ARTICLE 8. IN-HOME HEALTH CARE FOR THE ELDERLY ACT.
§9-8-1. In-home health care and elder-care made available to
seniors.
The Department of Health and Human Resources shall make
elder-care and in-home health care available to all persons who are
age sixty-five or older.
§9-8-2. Cost determined according to ability to pay.
The cost such care is to be determined according to the
recipient's ability to pay. The Secretary of Health and Human
Resources shall propose rules for legislative approval in
accordance with the provisions of article three, chapter
twenty-nine-a of this code.
NOTE: The purpose of this bill is to make elder-care and
in-home health care available to senior citizens on a sliding fee
scale.
