A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §51-2A-25, all relating to the ability of family courts to order services provided by the Department of Health and Human Resources; and the costs for those services remain expenses of the department.
Be it enacted by the Legislature of West Virginia:
In the course of fulfilling its duties under this article, a family court judge may order that a party participate in, complete, or otherwise avail himself or herself of a program or service provided by the Department of Health and Human Resources. In those circumstances, the department shall bear the cost of providing those services.
NOTE: The purpose of this bill is to clarify the ability of family courts to order services provided by the Department of Health and Human Resources; and establish that the costs for those services remain expenses of the department.
