A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §61-10-24, relating
to prohibiting fighting by juveniles on school grounds;
providing for suspension from school, fines, community service
and placement in alternative schools.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §61-10-24, to read as
follows:
ARTICLE 10. CRIMES AGAINST PUBLIC POLICY.
§61-10-24. Fighting by juveniles on public school grounds.
Any juvenile, convicted of assault or battery while on school
grounds shall for a first offense, in addition to the sentence
imposed for the assault or battery, be suspended from school for
not more than ten days and ordered to pay court costs and ordered
to perform community service for twenty hours; and for a second
offense be suspended from school for not more ten days and ordered
to pay court costs, and be fined twenty-five dollars; and for a third or subsequent offense be suspended from school for ten days
and ordered placed in an alternative school as a violent student
and fined fifty dollars and be ordered to pay court costs.
NOTE:
The purpose of this bill is to make fighting on school
grounds by juveniles a crime against public policy and to provide
for suspension from school, fines, community service and placement
in alternative schools for juveniles convicted.
