HOUSE CONCURRENT RESOLUTION 58

Requesting the Joint Committee on Government and Finance to study
the feasibility of impounding and auctioning off a motor
vehicle in the event that the owner of the motor vehicle has
been convicted of driving with no insurance three or more
times.

HEREAS
, Under state law all motor vehicles in West Virginia
are required to be covered with adequate car insurance; and

HEREAS
, Almost 5% of the roughly 50,000 crashes per year in
the state involve uninsured motor vehicle claims; and

HEREAS
, These claims often result in increased insurance
premiums for those with insured vehicles; and

HEREAS
, With this in mind, the West Virginia Legislature
intends to look at various avenues to address this ample concern;
and

HEREAS
, These avenues may consist of, but not be limited to
establishing a policy in which uninsured vehicles of owners with
multiple uninsured convictions are impounded and put up for public
auction, using the proceeds from the sale of the vehicle to create a fund to compensate victims of uninsured and underinsured
motorists and to prohibit uninsured vehicle operators from
instituting lawsuits for damages; therefore be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the feasibility of impounding and selling at
public auction, uninsured motor vehicles in the event that the
owner of the motor vehicle has been convicted of driving with no
insurance for three or more times of knowingly operating a vehicle
upon any road or highway; and be it
Further resolved, That the expenses necessary to conduct the
study and to prepare reports, recommendations and proposed
legislation be paid from the legislative appropriations to the
Joint Committee on Government and Finance.
