HOUSE CONCURRENT RESOLUTION 65

Requesting the Joint Committee on Government and Finance study the effects of eliminating the mandatory inspection of motor vehicles, trailers, semitrailers, pole trailers, antique motor vehicles, and motorcycles registered in the state.

Whereas, The State of West Virginia has nearly two million vehicles registered within her borders; and

Whereas, Each of those vehicles is required to be inspected by a service station pursuant to requirements established by the Superintendent of the State Police; and

Whereas, A fee may be assessed upon the vehicle owner at the time of inspection by the service station performing the inspection; and

Whereas, Such a fee is capped by law and meant to reimburse the service station for its time in providing an inspection; and

Whereas, This fee is often inadequate compensation to the service station as the cost of labor may exceed the amount allotted in code; and

Whereas, The practice of mandatory vehicle inspections has become a burden for vehicle owners as automobile manufacturing technology advancements provides for safer and more reliable autos; and

Whereas, The mandatory inspection of motor vehicles is becoming less necessary in the age of smart and internet connected automobiles that can self-monitor its own maintenance needs; and

Whereas, The House Committee on Technology and Infrastructure finds that the issue of mandatory vehicle inspections requires in-depth consideration from all sides of the issue; therefore, be it

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is hereby requested to study the effects of eliminating the mandatory inspection of motor vehicles, trailers, semitrailers, pole trailers, antique motor vehicles, and motorcycles registered in the state,

Further Resolved, That the Joint Committee on Government and Finance report to the Legislature, on the first day of the regular session twenty twenty-four, on its findings with any suggestions for legislation to effectuate its recommendations; and, be it,

Further Resolved, That the expenses necessary to conduct this study, to prepare a report, and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
