A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §50-6-4, relating to
requiring judgment debtors to make monthly reports to
magistrate court concerning whether the judgment debt is being
paid or has been wholly satisfied.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §50-6-4, to read as
follows:
ARTICLE 6. ENFORCEMENT OF CIVIL JUDGMENTS.
§50-6-4. Monthly reports by judgment debtors.
When a civil judgment rendered in magistrate court becomes
final, the judgment debtor shall submit monthly reports to the
magistrate court, on a form prescribed by the Supreme Court of
Appeals, concerning the progress, if any, that has been made toward satisfying the judgment. A judgment debtor's obligation to make
monthly reports under this section terminates upon the submission
of a final report, certified by the judgment creditor, that the
judgment debt has been wholly satisfied.
NOTE: The purpose of this bill is to
require judgment debtors
to make monthly reports to magistrate court concerning whether the
judgment debt is being paid or has been wholly satisfied.
