A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §7-20-11, relating to
authorizing municipalities to utilize the provisions of
article twenty of chapter seve of said code.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §7-20-11, to read as
follows:
ARTICLE 20. FEES AND EXPENDITURES FOR COUNTY DEVELOPMENT.
§7-20-11. Municipalities authorized to collect fees.
The provisions of this article may be used by any
municipality:
Provided, That any school impact fee imposed by
county ordinance must be collected and remitted to the school board
in the full amount set by the county school impact fee ordinance.
NOTE: The purpose of this bill is to allow municipalities to
assess and collect impact fees to offset the cost of commercial and residential development in the same manner as done by counties.
