A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §17-2E-1, relating to
compelling the Division of Highways to build a four-lane
highway between Chelyan, West Virginia, and Montgomery, West
Virginia, named the Lou Tabit Freeway; and time frame for let
to contract and contract.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §17-2E-1, to read as
follows:
ARTICLE 2E. LOU TABIT FREEWAY.
§17-2E-1. Construction of Lou Tabit Freeway.
(a) Notwithstanding any code provision to the contrary, the
Commissioner of the Division of Highways shall construct a four
lane highway between Chelyan, West Virginia and Montgomery, West
Virginia.
(b) The four lane highway identified in subsection (a) of this
section shall be known as the "Lou Tabit Freeway".
(c) Upon the effective date of this section, the commissioner
will immediately let to contract for the construction of the Lou
Tabit Freeway, the contract for which shall be executed on or
before September 1, 2013.
NOTE: The purpose of this bill is to compel the Division of
Highways to build a four lane highway between Chelyan, West
Virginia and Montgomery, West Virginia, and name it the Lou Tabit
Freeway.
