A BILL to repeal section six, article nine-a, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to the prohibition of imposing more restrictive laws, rules or regulations on the use, sale or distribution of tobacco products.
Be it enacted by the Legislature of West Virginia:
ARTICLE 9A. TOBACCO USAGE RESTRICTIONS.
§
1.
Repeal of section relating to the prohibition of imposing
more restrictive laws, rules or regulations on the use
sale or distribution of tobacco products.
Section six, article nine-a, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, is hereby repealed.
NOTE: The purpose of this bill is to repeal the provision of code that would prohibit state agencies, counties, municipalities or political subdivision from enacting more restrictive smoking laws or regulations than were in place as of January 1, 1993, unless such restrictions are accomplished through an amendment to the state code.
