A BILL to amend and reenact section six, article three, chapter
twenty-four-a of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, relating to minimum
rates, fares and charges of contract carriers by motor
vehicle; providing the public service commission with
greater regulatory flexibility by deleting the requirement
that rates, fares and charges shall not be less than those
prescribed for common carriers by motor vehicle for
substantially the same service.
Be it enacted by the Legislature of West Virginia:
That section six, article three, chapter twenty-four-a of
the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:
ARTICLE 3. CONTRACT CARRIERS BY MOTOR VEHICLES.
§24A-3-6. Rules; minimum rates, fares and
charges.
The commission is hereby vested with power and authority,
and it is hereby made its duty, to prescribe rules
and
regulations covering the operations of contract carriers by motor
vehicles in competition with common carriers of this state, and
the commission shall prescribe minimum rates, fares, and charges
to be collected by such contract carriers by motor vehicle.
which shall not be less than the rates prescribed for common
carriers by motor vehicles for substantially the same service.
NOTE: The purpose of this bill is to provide the Public
Service Commission with greater regulatory flexibility by
permitting the Commission to authorize contract carriers to
collect rates, fees and charges irrespective of those collected
by common carriers.
