A BILL to amend article five, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section twenty,
relating to providing a discount on state park campsite
rental fees to certain disabled veterans.
Be it enacted by the Legislature of West Virginia:
That article five, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
twenty, to read as follows:
ARTICLE 5. PARKS AND RECREATION.
§20-5-20. Discounts for disabled veterans.
(a) Upon application, the director shall issue to the
eligible veteran a discount card that may be used to obtain the
discount described in subdivision (b) of this section.
(b) Upon presentation of a discount card described in
subsection (a) of this section, no operator of any campground
under the jurisdiction of the director may charge the eligible
veteran to whom the discount card has been issued more than one-half of the campground's scheduled rental fee for an available
campsite rented and used by the eligible veteran. The discount
described in this subsection shall be extended to the eligible
veteran on any day of the year that a campsite is available.
(c) For purposes of this section, "eligible veteran" means
a veteran who was discharged from the armed forces of the United
States under honorable conditions who:
(1) iIs a resident of the state of West Virginia; and
(2) Has a total and permanent disability of the lower
extremities.
(d) The director shall propose for promulgation legislative
rules in accordance with the provisions of chapter twenty-nine-a
of this code to prescribe the manner in which eligibility for a
discount card described in this section may be established.
