A BILL to amend article ten, chapter seventeen-c of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
seven, relating to requiring persons jogging after dark to
wear reflective, luminous clothing and shoes.
Be it enacted by the Legislature of West Virginia:
That article ten, chapter seventeen-c of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
seven, to read as follows:
ARTICLE 10. PEDESTRIANS' RIGHTS AND DUTIES.
§17C-10-7. Pedestrian joggers to wear reflective, luminous clothing and shoes after dark.
Any person who jogs on, near or immediately adjacent to any
public road or highway, during any time in which the sun sets, shall wear a reflective, luminous material on the front and back
of an outer garment worn on his or her person and on the heel and
toe portion of his or her footwear. The reflective, luminous
material shall be of sufficient size and characteristics to be
clearly visible upon reflecting luminescence from a light source
equal or greater than the candlepower of a single headlamp of
sufficient intensity to comply with the requirements of section
twenty-three, article fifteen of this chapter.
NOTE: The purpose of this bill is to require persons
jogging after dark to wear reflective, luminous clothing and
shoes.
