A BILL to amend and reenact section sixty, article two, chapter
twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, related to exempting persons who hunt waterfowl from the requirement to wear orange during firearms hunting in deer season; and deleting the provision that exempts persons hunting on their own land from wearing orange.

Be it enacted by the Legislature of West Virginia:
That section sixty, article two, chapter twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:

ARTICLE 2. WILDLIFE RESOURCES.

§20-2-60. Required attire for deer hunters; exemption; penalty.

Any person who hunts deer on public lands or the lands of another during the period designated for firearms hunting of deer shall wear a daylight fluorescent orange outer garment over at least four hundred square inches of his person: Provided, That persons engaged in agricultural occupations hunting migratory waterfowl shall be exempt from the provisions of this section. while hunting deer on their own property Any person violating any provision of this section is guilty of a misdemeanor, and, upon conviction thereof, shall be fined not less than five dollars nor more than fifty dollars.





NOTE: The purpose of this bill is to exempt persons who hunt migratory waterfowl from wearing orange during firearm hunting in deer season. The bill also deletes the exemption from wearing orange under current law for persons who hunt on their own land.
