A BILL to amend article thirteen, chapter eight of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
fifteen-b, relating to municipal corporations; taxation and
finance; and deferred payment of magistrate court fees.
Be it enacted by the Legislature of West Virginia:
That article thirteen, chapter eight of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
fifteen-b, to read as follows:
ARTICLE 13. TAXATION AND FINANCE.
§8-13-15b. Deferral of payment of magistrate court fees imposed in the collection of municipal taxes, fines, fees
and assessments.
Municipalities are hereby granted a deferral of filing fees
or other fees and costs incidental to the bringing and
maintenance of an action in magistrate court for the collection
of any delinquent taxes, fines, fees and assessments authorized
under any of the provisions of this chapter. If the municipality
collects the delinquent tax, fine, fee or assessment, plus fees
and costs, from the defendant or other responsible party, the
municipality shall pay to the magistrate court the filing fees or
other fees and costs which were previously deferred.
NOTE: The purpose of this bill is to defer payment of
magistrate court fees for municipalities until such fees are
collected by the municipalities.
