A BILL to amend and reenact section one, article two-b, chapter
forty-eight of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to the visitation
rights of grandparents with their grandchildren.
Be it enacted by the Legislature of West Virginia:
That section one, article two-b, chapter forty-eight of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 2B. CHILD VISITATION.
§48-2B-1. Grandparents' visitation.
(a) The circuit court, upon petition, shall grant
grandparents reasonable visitation rights as the court shall
determine with respect to the grandchild, regardless of the
marital status of the parents of the child or the relationship of
the grandparents to the person having custody of the child.
(b) The action shall be brought in the circuit court in the
county in which the child resides.
NOTE: The purpose of this bill is to permit a grandparent
to seek, through petition and court order, visitation rights with
their grandchildren.
