A BILL to amend and reenact section four-b, article five-f, chapter twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to residential solid waste disposal.

Be it enacted by the Legislature of West Virginia:

That section four-b, article five-f, chapter twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:
ARTICLE 5F. SOLID WASTE MANAGEMENT ACT.

§ 20-5F-4b. Special provision for residential solid waste disposal.

All commercial and public solid waste facilities shall issue permits which will be valid for one year to allow establish and publish a yearly schedule providing for one day per month on which a permit person persons not in the business of hauling or disposing of solid waste, who is a are resident residents of the wasteshed in which the facility is located, may to dispose of an amount of residential solid waste up to one pick-up truckload or its equivalent, free of all charges and fees on any normal day of operation: Provided, That the persons submit an application to the solid waste authority indicating proof of low income and the inability to pay the costs of disposal or garbage service fees and that the application be approved by the solid waste authority before an issuance of a permit. The permit may be renewed each year upon submission and approval of a new application.




NOTE: The purpose of this bill is to permit persons who qualify as having a low income and inability to pay the costs of disposal or garbage service to dispose of their garbage with no fees and to issue renewable permits allowing these persons to have free disposal.
