A BILL to amend article three-b, chapter twenty-nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section seven-a, relating to establishing a voluntary electrical wiring inspection program in the office of the state fire marshal; providing for a fee for inspections; and providing that fees collected shall be used to defray costs of the program.

Be it enacted by the Legislature of West Virginia:

That article three-b, chapter twenty-nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section seven-a, to read as follows:
ARTICLE 3B. SUPERVISION OF ELECTRICIANS.

§ 29-3B-7a. Fire marshal to inspect wiring of buildings at owner's request; reports; fees.

Any property owner in this state may request the fire marshal or his or her designee to inspect electrical wiring installed by a licensed electrician on the premises of the property owner to determine if the electrical wiring has been installed according to the standards of the national electrical code as promulgated by the national fire protection association. A fee, as determined by the fire marshal sufficient to cover the cost of the inspection, shall be charged to the property owner by the fire marshal for this service. The fire marshal shall make a report, in writing, of his or her findings and recommendations to the property owner.

All fees collected under the provisions of this section shall be placed in a special account in the state fire marshal's office to be used to defray the cost of implementing the voluntary inspection program. The fire marshal shall make a report to the state auditor of all expenses and income associated with this account at the end of each fiscal year.



NOTE: The purpose of this bill is to establish a voluntary electrical wiring inspection program in the office of the state fire marshal. Under the bill, property owners may request the state fire marshal to inspect electrical wiring on the property owner's premises. The fire marshal or his or her designee is required to do the inspection for a fee determined by the fire marshal sufficient to cover the cost of the inspection and give the property owner a report on the results of the inspection. Moneys collected from the fees are to be used to defray the cost of the program and to pay for the actual and necessary expenses of the voluntary inspection program.
