HOUSE CONCURRENT RESOLUTION NO. 1003

Frederick and Browning)
Directing the Joint Committee on Government and Finance to make
a study of the practices, control and operation of private,
for-profit cemeteries in and for the State of West Virginia.
Whereas,
The fees charged by cemeteries in West Virginia are
continuing to rise and may need to be regulated; and
Whereas,
The long established monument companies in West
Virginia are no longer permitted by the cemeteries to properly
install stones possibly because the cemeteries are now selling
them and may be charging higher prices to install them; and
Whereas,
Some cemeteries may be failing to properly maintain
the grave sites; and
Whereas,
The Federal Trade Commission reportedly finished a
three-year study and ruled that each state shall pass their own
laws to control the operation of cemeteries within their state;
and
Whereas,
Some states have drafted legislation controlling
the operation of cemeteries within their state; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
directed to review, examine and study the operations, the fees
charged, the installation of stones and markers and the
maintenance of the grave sites of private, for-profit cemeteriesin the State of West Virginia and make recommendations to the
Legislature regarding the same; and, be it
Further Resolved,
That the said Joint Committee on
Government and Finance report to the regular session of the
Legislature, 1995, on its findings, conclusions and
recommendations, together with drafts of any legislation
necessary to effectuate its recommendations; and, be it
Further Resolved,
That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
