HOUSE CONCURRENT RESOLUTION 26

Requesting the Joint Committee on Government and Finance to make a study of the workers' compensation fund administrative operations.

Whereas, The Legislature recognizes that a well-run workers' compensation fund division benefits both employees and employers in the state; and
Whereas, In recent years the administrative expenses of the workers' compensation fund have risen significantly; and
Whereas, In a five-year period the administrative expenses increased thirty million dollars, from seventeen million dollars in 1991 to forty-seven million dollars in 1996; and
Whereas, The Legislature recognizes that the administration of the workers' compensation fund has improved, including the area of collecting delinquent employer premiums; and
Whereas, Due to the complexity of the administrative operation of the workers' compensation fund, it is difficult for the Legislature to comprehensively evaluate the administration within the sixty-day legislative session; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to study and evaluate the workers' compensation fund administrative operations; and, be it
Further Resolved, That the Jjoint Ccommittee on Ggovernment and Ffinance report to the regular session of the Legislature, 1998 on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation to be paid from legislative appropriations to the Joint Committee on Government and Ffinance.
