A BILL to amend and reenact section three, article four, chapter
sixty-four of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to authorizing the
division of culture and history to promulgate legislative
rules relating to standards and procedures for granting
permits to excavate archaeological sites and unmarked
graves.
Be it enacted by the Legislature of West Virginia:
That section three, article four, chapter sixty-four of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 4. AUTHORIZATION FOR DEPARTMENT OF EDUCATION AND THE
ARTS TO PROMULGATE LEGISLATIVE RULES.
§64-4-3. Division of culture and history.
(a) The legislative rules filed in the state register on the
eighth day of August, one thousand nine hundred ninety, modifiedby the division of culture and history to meet the objections of
the legislative rule-making review committee and refiled in the
state register on the sixteenth day of January, one thousand nine
hundred ninety-one, relating to the division of culture and
history (standards and procedures for granting permits to
excavate archaeological sites and unmarked graves), are
authorized.
(b) The legislative rules filed in the state register on the
sixteenth day of August, one thousand nine hundred ninety-three,
modified by the division of culture and history to meet the
objections of the legislative rule-making review committee and
refiled in the state register on the first day of December, one
thousand nine hundred ninety-three, relating to the division of
culture and history (standards and procedures for granting
permits to excavate archaeological sites and unmarked graves),
are authorized.
