A BILL to amend chapter twenty-nine of the code of West Virginia,
one thousand nine hundred thirty-one, as amended, by adding
thereto a new article, designated article twenty-four,
relating to creating a board to license recreation
personnel.
Be it enacted by the Legislature of West Virginia:
That chapter twenty-nine of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, be amended by
adding thereto a new article, designated article twenty-four, to
read as follows:
ARTICLE 24. RECREATION BOARD.
§29-24-1. Creation of recreation board; members; terms;
officers.
The authority to supervise persons working in the recreation
field shall be vested in a recreation board. The board shall
consist of three persons appointed by the governor, by and with
the consent of the Senate, no more than two of whom shall belong
to the same political party and no two of whom shall be residents
of the same county at the same time. The members shall serve
without pay. Each appointed member shall serve for a term of
four years. The members of the recreation board, established
pursuant to this article, shall elect their own chairman and
secretary and select all other necessary officers. The secretary
shall keep the records of the proceedings of the board. The
concurrence of at least two members shall be necessary to render
a decision of the board.
§29-24-2. Office of recreation board.
The board, at its discretion, may designate as its official
headquarters the residence or place of business of any one of its
members.
§29-24-3. License requirement.
After the thirty-first day of December, one thousand nine
hundred ninety-six, no person shall be employed in the recreation
field unless they have obtained a license from the board.
§29-24-4. Powers and duties of board.
(a) The board shall:
(1) Establish moral, educational, examination, experience or
other requirements, as it deems appropriate, for the issuance of
a license to work in the recreation field;
(2) Establish the appropriate state license fees necessary
to pay the expenses incurred by the board in performing its
duties;
(3) Keep records of each licensee's education, examination
score, experience or other information the board deems
appropriate.
(b) The board is authorized to promulgate rules detailing
how it shall be determined who is fit to work in the recreation
field and who is not.
§29-24-5. Expense of recreation board; application fees.
Each applicant shall pay the state license fee established
by the board in the form of a certified check or money order and
shall be issued to the treasurer of the state of West Virginia to
be deposited in the general fund. On or before the thirty-first
day of December of each year, the secretary of the board shall
present to the governor projected revenues and expenses for the following year. The projected revenues shall include the state
license fees collected. The projected expenses shall include all
expenses of the board and the board related expenses of its
headquarters. Necessary expenses incurred by the board shall be
submitted on a standard expense form to the treasurer of the
state of West Virginia to be paid from the general fund.
NOTE: The purpose of this bill is to create a board to
license recreation personnel.
